These Online Shopping Terms and Conditions, the use of this website and any order or purchase made through the facilities of this website shall be governed by the laws of the Singapore. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

You may only purchase or order items for non-commercial and lawful purposes and any other use is not permitted. You agree to pay for all charges noted herein as payable by you. You have to be 18 or older to purchase from the website.

ACTIV360 may correct errors or inaccuracies and change or update information on this website at any time without notice, including in respect of prices and availability of items. All prices listed on this website are in Singapore dollars and all charges will be processed in Singapore dollars.

All prices listed on this website are subject to confirmation. ACTIV360 will notify you by eMail within hours of making a purchase if the confirmed price of an item you have selected differs from the price listed on the website or on your purchase order. If you do not receive an eMail within 24 hours of completing a purchase order, ACTIV360 is deemed to have confirmed the purchase at the price listed. If you receive such notification, the sale will be automatically terminated unless you reply by eMail with confirmation of your intention to purchase the item at the confirmed price.

ACTIV360 reserves the right to limit the quantities of certain items which you, your family or any group can purchase. ACTIV360 will use commercially reasonable efforts to deliver items as quickly as possible and within any time periods indicated; however, ACTIV360 will not be responsible for any delays in delivery which are beyond its control. Where delivery is delayed, ACTIV360 will notify you as soon as possible.

Fraud Prevention
In order to protect you and ACTIV360 from fraudulent transactions, ACTIV360 may provide your transaction-related information to a reputable third party organization to perform an address verification. This address verification is intended to ensure that the "bill to" address that you provide matches your credit card address. ACTIV360 also reserves the right, at its discretion, not to ship items ordered or purchased on this website to certain addresses. In the event that ACTIV360 chooses not to ship an item, you will be notified by eMail and any amount charged to your credit card will be refunded.

WAIVER / INDEMNITY (This is only applicable for our "Sign Up Programs")  

I hereby agree to the following terms and conditions of my participation in ACTIV360 5k/10k/21k Run Team Training Program (hereby refer as the Training Program) .

1. I acknowledged and agreed that:
(a) My participation in the Training Program is entirely voluntary on my own part;

2. I have read, understood and accepted the Rules and Regulations applicable to the Training Program.

3. I have been made fully aware of, and fully understand and acknowledge the risks involved in my participation in the Training Program.  I accept full responsibility and assume all such risks.

4. I hereby represent, undertake and warrant ACTIV360 with full knowledge that they shall be relied upon in accepting my participation:-
(a) My personal particulars disclosed herein are correct;
(b) I have no medical condition that would affect my safety and physical well being arising from my participation in this Training Program and that I am medically and physically fit and competent to participate in the Training Program; (c) I shall dutifully and fully abide by the Rules and Regulations of this Training Program and any applicable laws.

5. I confirm that the representations, warranties and undertakings above are true and correct and I (and my heirs, successors and assignees) shall waive, release, discharge you from any claim and undertake that I (and my heirs, successors and assignees) shall not make any claim or complaint whatsoever against ACTIV360 for any loss or damage or injury sustained by me, or for my death arising from or during the Training Program.

6. Further, I (my heirs, successors and assignees) shall indemnify and hold ACTIV360 harmless from any claim, demand, proceeding, cost, expense, liability, loss or damage (whether direct or consequential) made by any third parties, arising from any injury or death or damage or loss to any property arising out of my breach of the representations, warranties and undertakings under Clause 5 herein. PROVIDED ALWAYS that ACTIV360 shall be entitled in your sole and absolute discretion to disqualify me from the Training Program if I shall breach any of the representations, warranties and undertakings herein in any way whatsoever.

7. I declare to the best of my knowledge that I do not suffer from any of the following pre-existing medical conditions:
(a) any cardiac or respiratory weakness or ailment;
(b) epilepsy or any other neurological condition;
(c) any orthopaedic or rheumatological complaint; or
(d) any other complaint or condition which would involve a serious risk to any physical or mental health by my participation in the Training Program.

8. For the avoidance of doubt, in consideration of you accepting my entry into the Training Program, I hereby confirm my agreement to waive any claim (to the extent permitted under the laws of Singapore) which I (any of my heirs, successors and assignees) may otherwise be entitled to bring against ACTIV360 or your agents, employees, sponsors or contractors arising in any way out of my participation in the Training Program, including without limitation, any of the following:
(a) any injury, illness or death caused by or associated with my participation in the Training Program; (b) any fainting or other physical or nervous reaction to alarm, shock or fright suffered during the Training Program, whether such reaction manifests itself either during or at any time after the Training Program; or (c) the need for hospitalisation or any form of paramedic or out-patient care which may arise from (a) or (b) above.

9. I agree to receive all information pertaining to this Training Program by email.

10. No person who is not a party to this Waiver shall have any right under the Contracts (Rights of Third Parties) Act, Chapter 53B of Singapore, to enforce any of the terms herein.

OTHER TERMS & CONDITIONS:

1. Once registered,there will be no refund for payment made.
2. ACTIV360 reserve the right to postpone the Training Program due to various reasons.
